Privacy Policy
1) Introduction
This Privacy Policy explains how Punde Commerce LLC ("Punde," "we," "our," or "us"), a limited liability company organised under the laws of the State of Delaware, United States, collects, uses, shares, and protects personal information provided by users ("you," "your"). By accessing our website or using our services, you agree to the terms of this Privacy Policy.
We are committed to protecting your personal data. Depending on where you are located, you may have rights under the EU/UK General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), India's Digital Personal Data Protection Act, 2023, Australia's Privacy Act 1988 and the Australian Privacy Principles, Singapore's Personal Data Protection Act 2012, or Hong Kong's Personal Data (Privacy) Ordinance.
2) Information We Collect
We may collect the following types of personal information from you:
- Personal Identification Information: Name, email address, phone number, and company details.
- Usage Data: Information on how you use our website, including IP address, browser type, pages visited, time spent on the website, and other analytics.
- Transaction Data: Information regarding payments, invoices, and engagement details if you engage our services.
- Client Systems Data: Where you grant us access to your storefront, analytics, or marketing platforms to perform services, we may process data held in those systems on your behalf. In those cases you are the data controller and we act as a processor under your instructions.
3) How We Use Your Information
We use the information collected for the following purposes:
- To provide, operate, and maintain our services.
- To improve our website's functionality and content based on user behavior.
- To communicate with you regarding our services, projects, and other updates.
- To process transactions and provide customer support.
- To comply with legal obligations and prevent fraud.
We do not use your personal information for automated decision-making that produces legal or similarly significant effects.
4) Legal Bases for Processing
Where the GDPR applies, we process personal data on the following legal bases: performance of a contract with you; our legitimate interests in operating and marketing our services; your consent, where requested; and compliance with legal obligations.
5) Cookies and Tracking Technologies
We use two kinds of storage on this website, and they are treated differently.
Essential and functional storage is always active and does not require your consent. It is limited to what the site needs in order to work: remembering the cookie choice you made so we do not ask again, and saving your progress through interactive checklists in your own browser. This storage stays on your device, contains no advertising or analytics identifier, and is never used to profile you.
Analytics and marketing cookies are only set if you accept them. These cover Google Analytics, Google Tag Manager, Hotjar, Microsoft Clarity and the Meta pixel, and they help us understand how the site is used and how our marketing performs. Until you accept, they are withheld — the scripts that require consent are not loaded at all, rather than loaded and told not to store anything.
Where consent is required. In the UK, the EU/EEA and Switzerland, analytics and marketing cookies are withheld until you accept them. Elsewhere they operate by default, in line with local law, and you can switch them off at any time.
Global Privacy Control. If your browser sends a Global Privacy Control signal, we treat it as a refusal of analytics and marketing cookies regardless of where you are, and we do not ask you again.
You can change your decision at any time using the Cookie preferences control in the site footer, or through your browser settings.
6) Email Newsletter
If you subscribe to our newsletter, we collect your email address along with the date of your subscription and the page you subscribed from. We process this on the basis of your consent, and we keep the subscription date as the record of that consent.
We use the newsletter to tell you when we publish new writing. We do not sell, rent, or share subscriber addresses with third parties for their own marketing.
Subscriber details are held in our own infrastructure on Google Firebase and are not passed to a third-party marketing platform. If we later move the list to an email service provider in order to send, we will update this policy to name that provider before we do so.
You can unsubscribe at any time by writing to contact@pundecommerce.com, and every email we send will carry an unsubscribe link. Unsubscribing removes you from future sends and we retain only the minimum record needed to honour that request.
7) How We Share Your Information
We do not sell, trade, or rent your personal information to third parties. However, we may share your information with trusted service providers for the following purposes:
- Payment processing and transactions.
- Website hosting, analytics, and marketing services.
- Compliance with legal obligations and law enforcement requests.
Each third-party service provider is bound by data protection agreements appropriate to the jurisdictions in which the data is processed.
International transfers. Our team and certain service providers operate outside the United States, including in India. Your personal data may therefore be transferred to, stored in, or processed in countries other than your own. Where required, such transfers are made under appropriate safeguards, including Standard Contractual Clauses.
8) Data Security
We implement reasonable security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. This includes physical, technical, and administrative safeguards.
However, no data transmission over the internet is completely secure, and we cannot guarantee the security of your data during transmission to our website. You acknowledge that any transmission of data is at your own risk.
9) Retention of Personal Information
We retain personal information for as long as necessary to fulfill the purposes for which it was collected and to comply with legal obligations. Once data is no longer required, it will be securely deleted or anonymized.
10) Your Data Protection Rights
Subject to your location and applicable law, you have the following rights regarding your personal data:
- Access and Update: You have the right to access the personal data we hold about you and request corrections or updates.
- Withdraw Consent: You can withdraw your consent for data processing at any time.
- Data Portability: You have the right to request a copy of the data in a structured, machine-readable format.
- Deletion: You can request the deletion of your personal data, subject to applicable legal retention obligations.
- Object or Restrict: You may object to or request restriction of certain processing, including direct marketing.
- Non-Discrimination: Where the CCPA/CPRA applies, we will not discriminate against you for exercising your rights.
- Complaints to a regulator: Where the Australian Privacy Act applies you may complain to the Office of the Australian Information Commissioner; in Singapore, to the Personal Data Protection Commission; in Hong Kong, to the Privacy Commissioner for Personal Data. We ask that you raise it with us first so we can try to resolve it.
- Marketing contact: We honour Singapore's Do Not Call registry and equivalent opt-out mechanisms elsewhere. You can opt out of direct marketing from us at any time by replying to any message or writing to the address below.
To exercise any of these rights, please contact us at contact@pundecommerce.com. We will respond within the timeframe required by applicable law.

13) Changes to This Privacy Policy
Punde reserves the right to update or modify this Privacy Policy at any time. Any changes will be reflected on this page, and we encourage you to review this policy periodically. Continued use of our website after changes constitutes your acceptance of the updated policy.
14) Governing Law and Dispute Resolution
This Privacy Policy is governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, except where the mandatory data protection laws of your country of residence apply.
